Oil Spill Victims Still Awaiting Compensation Under Settlement Programs

April 20, 2010 marked the worst marine environmental disaster in U.S. history. On that day an oil rig explosion in the Gulf of Mexico killed 11 men and injured 17 others. The Deepwater Horizon was on lease to BP – the company primarily responsible for the operation and development of the site. Oil spilled into the gulf for nearly three months until the well was finally capped on July 15. The ensuing damage devastated the Gulf Coast ecosystem and economy, and hundreds of lawsuits were filed in an attempt to help those who suffered physical or financial injury. Ultimately, BP negotiated a settlement program that was intended to be fair and efficient. That was approximately four years ago, yet thousands of BP claims remain unpaid.

Economic and Property Damages

A settlement agreement was approved on December 21, 2011, and the Court-Supervised Settlement Program (CSSP) began operating on June 4, 2012. BP’s unwillingness to abide by the terms of the agreement led to an appeal to the U.S. Supreme Court – an appeal which was ultimately denied. The CSSP was then finalized on December 8, 2014, and the deadline to file was set six months later on June 8, 2015. The CSSP was established to provide economic compensation to victims of the oil spill in a number of different categories, including economic losses for businesses, individual economic losses, real property sales losses, real property damage, vessel damage and more.

Medical Benefits

This provision of the CSSP was meant to help workers who participated in oil spill clean up operations between April 20, 2010 and April 16, 2012, as well as residents who lived in defined areas during specified time frames. It became effective on February 12, 2014. The deadline to file Deepwater Horizon claims under the Medical Benefits Settlement Program was February 12, 2015.
