Update on the 3M Combat Arms Earplugs Litigation

Hello again from Jason J. Joy & Associates. I hope this message finds you well. I'm writing to share some important updates on the 3M Combat Arms Earplugs litigation. As you know, this case involves allegations that 3M and its subsidiary, Aearo Technologies, sold defective earplugs to the U.S. military, leading to permanent hearing loss and tinnitus for many veterans.

Recently, a federal judge dismissed a bankruptcy filing by Aearo Technologies, holding that the 3M subsidiary was financially healthy and undeserving of bankruptcy protection. This move by Aearo was an attempt to settle the claims through the bankruptcy process which could lead to delays and reduced payments. The judge's decision, however, keeps the litigation on track in the federal court system.

Aearo has already filed an appeal. While this could create additional delays, it's a common occurrence in such large-scale litigations. We are monitoring this appeal closely and will adapt our strategy as needed.

Despite the complexities, the judge's initial dismissal of the bankruptcy filing puts 3M under increased pressure in ongoing settlement negotiations. Furthermore, the judge has ordered the scheduling of additional 3M earplug trials in U.S. District Courts nationwide. This development could potentially tip the scales in favor of the veterans.

On May 13, 2025, the U.S. Court of Appeals for the Third Circuit issued a ruling that dismissed several outstanding appeals related to the confirmation of the Boy Scouts of America’s bankruptcy plan. These appeals had been filed by certain abuse survivors and non-settling insurance carriers. As a result of this decision, the Settlement Trust has continued processing claims, issuing eligibility decisions, and making initial payments.
